The United States Tax Court is a special Federal court created by Congress to provide a court for taxpayers to dispute the IRS’s determination that they owe additional tax (commonly called a tax deficiency). Many taxpayers mistakenly believe that the Tax Court is simply another administrative branch of the IRS. Nothing could be further from the truth. The Tax Court is a formal court, presided over by a Federal Judge. The Tax Court has very specific and detailed rules of practice which are very different from any other court. Many taxpayers make the mistake of trying to represent themselves in Tax Court. The IRS is always represented by an experienced tax attorney. The Notice of Deficiency: Your Ticket To Tax Court

If you have received a Notice of Deficiency letter from the IRS, do not assume that it is a just another notice from the IRS about your tax dispute. A Notice of Deficiency is the IRS’s notice that they have determined that you owe additional tax and/or penalties generally due to an audit or examination of your tax return. In some cases, a taxpayer receives a Notice of Deficiency when the IRS has prepared a tax return on the taxpayer’s behalf, commonly called a substitute for return or SFR. When you receive a Notice of Deficiency, you have 90 days to file a petition with the U.S. Tax Court to preserve your right to contest the IRS’s proposed deficiency in taxes and penalties. If you fail to file a Tax Court Petition within the 90 day limit, the IRS will assess the taxes and penalties against you and begin collection activity including placing a lien on your property, levying on your wages, or seizing your retirement, savings, and other property.
